A standard Alabama rental agreement establishes a contractual relationship between a property owner and renter. Prior to executing a lease, the landlord should collect pertinent details about the prospective tenant such as personal identification, employment status, and financial background. This vetting process helps ensure the individual demonstrates the ability to fulfill their rental obligations in a timely manner.

Required Disclosures and Landlord-Tenant Laws and Responsibilities
In Alabama, landlord-tenant laws cover the basics of renting. Lease agreements can be verbal or written, but a written lease is recommended. Landlords can charge a security deposit up to one month’s rent, which must be returned within 60 days after moving out, minus any deductions for damages. They are required to keep rental properties in good condition and must give written notice to end a lease—typically 30 days for month-to-month agreements. Eviction requires a court process, and tenants have the right to privacy, meaning landlords must usually give 24 hours’ notice before entering. Discrimination based on race, religion, sex, or other factors is not allowed under federal law. For specific issues, consulting a lawyer or local housing authority is advisable.

Required Disclosures
For any home built before 1978, landlords must provide information about lead-based paint and the EPA pamphlet. The lease also needs to clearly state the name and address of the property manager or landlord. If the landlord wants notice for tenant absences over 14 days, it should be mentioned.
Security Deposits
The maximum a landlord can request is one month’s rent. This excludes pet fees or other liability charges. The deposit must be returned within 60 days of the end of the lease. If the tenant doesn’t provide a forwarding address within 90 days, the deposit is forfeited. Itemized deductions from the deposit require descriptions.
Rent Payment
Rent is due on the date listed in the lease, usually the 1st of the month. There is no grace period, so landlords can start the eviction process after 7 days. Late fees aren’t capped by law. The NSF fee is $30. Tenants cannot withhold rent for repairs.
Landlord Access
Landlords must provide 2 days’ notice before entering for maintenance, repairs or showings. They can enter immediately in emergencies or with a court order.
Abandoning the Property
If stated in the lease, tenants must notify landlords of absences over 14 days. Landlords can then enter. Breaking the lease early makes tenants liable for rent and damages, like attorney fees. Landlords must make reasonable efforts to re-rent it. Utility shutoffs for 7 days or leaving property for 14 days after the lease ends means it’s considered abandoned.
